FREENY PATENT STRIKES AGAIN: EUROPEAN PARTIES SETTLE LITIGATION
The Freeny Patent strikes again!
E-DATA, the owner of the Freeny patent, announced on January 20, 2004 that a world-wide agreement for past and future royalties was signed with On Demand Distribution (OD2). This agreement settles the infringement actions E-DATA was pursuing against OD2, HMV Group, Tiscali, a subsidiary of Tiscali, and Microsoft Deutschland, a subsidiary of Microsoft.
The controversial Freeny patent, which has often been decried as overly broad, was originally upheld by the U.S. Court of Appeals for the Federal Circuit in 2000. The CAFC held that the Freeny patent was valid and that the claimed system covered the transmission and copying of such things as music, movies and video games from one location to an object such as paper, recording tape or video disc to be purchased at another location. Following this decision, E-DATA was capable of settling similar lawsuits and arranging licensing arrangements with numerous software and internet service providers.
Apple's iTUNES and Napster's services posibly also infringes the Freeny patent and may be the target of the next wave of lawsuits according to MAC UK.
